WHAT IS A COMMON LAW MARRIAGE?

 

Texas recognizes a common law marriage, or more precisely, a marriage without formalities.  In order to establish an informal marriage you must either properly file a proper Declaration and Registration of Informal Marriage, or prove in Court that you and your "spouse": (1) agreed to be married; (2) after that agreement lived together in Texas as husband and wife; and (3) represented to others that you were married).

 

 

SHOULD I HIRE A LAWYER FOR A COMMON LAW MARRIAGE SITUATION?

 

While the provisions of the code dealing with informal marriages may seem simple, they are quite complicated and proof/denial of a common law marriage is complex and fact-intensive process and I would NOT recommend that anyone attempt to handle such a matter without legal representation. 

 

 

IS THERE A TIME LIMIT I HAVE TO ESTABLISH A COMMON LAW MARRIAGE?

 

Yes, there is a statutory time limit for instituting the lawsuit to prove the alleged common law marriage.  Therefore, time is of the essence and you should contact an attorney immediately to discuss your legal rights.
