An adult may file a petition requesting a change of name in the county of the adult's residence. Generally, the grant of an application for name change is a matter of judicial discretion (i.e. its the judges decision) and should be granted unless there exists some wrongful, fraudulent or capricious purpose. A court shall order a name change if the applicant does not have a felony conviction and the name change would be a benefit to the petitioner and in the interest of the public. If an applicant has a felony conviction then the applicant needs: (1) a certificate of discharge by the pardons and parole division of the Texas Department of Criminal Justice or completed a period of probation ordered by a court and not less than two years have passed from the date of the receipt of discharge or completion or probation; or (2) to have been pardoned. A name change will not affect your rights or liabilities. |

A parent, managing conservator or guardian of a child may file a petition requesting a change of name for a child in the county where the child resides. However, unlike adult name changes, name changes of children must make certain issue and serve citations to any interested parties to the child's name change including: (1) a parent of the child whose parental rights have not been terminated; (2) any managing conservator of the child; (3) any guardian of the child. A court may order the name change of a child if it is in the best interest of the child. Like adult name changes, the name change of the minor will not affect the child's rights or liabilities. |

HOW MUCH WILL A NAME CHANGE COST? |

This question is difficult to answer because the complexity (or lack thereof) of each individual’s situation will determine the amount of time that is necessary to prepare and execute a name change. As a general rule an adult's name change will almost always be cheaper than the name change of a minor for two reasons: (1) no notification is required; (2) because no notification is required, an adult's name change will not likely be contested. When you hire an attorney to assist you in preparing a will, make sure that you fully understand the fee structure and that you are comfortable with the fee arrangement.
